End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you and HappyGophers LLC ("HappyGophers," "we," or "us") for the application titled Your Handy Camping Checklist, including all content, updates, and documentation (the "Software"). By downloading, installing, or using the Software, you agree to be bound by this Agreement. If you do not agree, do not download, install, or use the Software.

1. Acknowledgement

This Agreement is between you and HappyGophers only, and not with Apple Inc. ("Apple"). HappyGophers, not Apple, is solely responsible for the Software and its content. Where this Agreement provides usage rules that are less restrictive than, or otherwise conflict with, the Usage Rules in the Apple Media Services Terms and Conditions, the more restrictive or conflicting Apple term applies.

2. License Grant and Scope

HappyGophers grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on Apple-branded devices that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, solely for personal, non-commercial use. The Software may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where Apple permits it. The Software is licensed, not sold. This license does not transfer any ownership rights to you.

3. Local Data and No Data Collection

The Software is a local application. It operates entirely on your device and does not connect to external websites, servers, or online services. HappyGophers does not collect, track, transmit, or store any of your personal data or checklist information on its servers. The only exception is functionality required by, and provided through, Apple and the App Store, such as purchase and receipt validation, crash reporting, and App Store analytics. That functionality is operated by Apple under Apple's own terms and privacy policy; HappyGophers receives only the aggregated or de-identified reports that Apple makes available to developers. All checklist data is stored only on your device. Deleting the Software or clearing its storage permanently erases that data, and HappyGophers cannot recover it. You are responsible for any exports or backups you wish to keep.

4. Curated Trip Suggestions and Safety Disclaimer

The Software may provide guided or curated trip checklists with suggested items. These suggestions are based on general research and real-world experience and are intended only as helpful starting points. They do not constitute professional advice.

Some items (including but not limited to footwear, clothing, and food) are intentionally left unselected because they depend on personal preference, individual needs, and specific conditions. You are solely responsible for reviewing, modifying, and completing any checklist to suit your particular trip, location, weather, group size, and personal requirements. HappyGophers makes no representation or warranty that any suggested list is complete or appropriate for your situation.

The Software is a planning aid only. You are solely responsible for your own safety and the safety of your group, including drinking water, food safety, medical needs, and compliance with local laws, permits, fire restrictions, wildlife guidance, and weather conditions.

5. Maintenance and Support

HappyGophers is solely responsible for providing any maintenance and support for the Software, as specified in this Agreement or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services for the Software.

6. Warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HAPPYGOPHERS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. HAPPYGOPHERS DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR MEET YOUR SPECIFIC REQUIREMENTS.

Notwithstanding the foregoing, and solely for purposes of the Apple App Store, HappyGophers is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Software to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Software to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Software, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of HappyGophers.

7. Restrictions

You may not:

Copy, share, distribute, sell, rent, lease, sublicense, or transfer the Software or any part of it, except as expressly permitted by the Usage Rules
Modify, adapt, reverse engineer, decompile, disassemble, or create derivative works based on the Software
Remove, alter, or obscure any copyright, trademark, or other proprietary notices
Use the Software for any commercial purpose

8. Ownership and Intellectual Property

The Software, including its code, design, layout, content, and all related intellectual property, is owned by HappyGophers LLC and is protected by United States copyright and other intellectual property laws. All rights not expressly granted in this Agreement are reserved by HappyGophers.

In the event of any third-party claim that the Software, or your possession and use of the Software, infringes that third party's intellectual property rights, HappyGophers, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

9. Third-Party Components and Terms

The Software includes the Bree Serif and Caveat typefaces, each licensed under the SIL Open Font License, Version 1.1. These fonts remain the property of their respective copyright holders. The applicable copyright notices and the full text of the SIL Open Font License are available from within the Software's About screen under Font Licenses.

You must comply with any applicable third-party terms of agreement when using the Software, including the terms of your wireless data service provider.

10. Product Claims

HappyGophers, not Apple, is responsible for addressing any claims by you or any third party relating to the Software or your possession and/or use of the Software, including but not limited to: (i) product liability claims; (ii) any claim that the Software fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAPPYGOPHERS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SOFTWARE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF HAPPYGOPHERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL HAPPYGOPHERS LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SOFTWARE EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE (IF ANY).

12. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a United States Government embargo, or that has been designated by the United States Government as a "terrorist supporting" country; and (ii) you are not listed on any United States Government list of prohibited or restricted parties. You agree to comply with all applicable export control laws and regulations.

13. Termination

This license is effective until terminated. HappyGophers may terminate this license at any time if you fail to comply with any term of this Agreement. Upon termination, you must immediately stop using the Software and delete it from all of your devices.

14. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to the jurisdiction of those courts.

15. Changes to this Agreement

HappyGophers reserves the right to update this Agreement from time to time. We will notify you of material changes by updating the Effective Date and, where practicable, by an in-app notice. The current version is available within the Software. Continued use of the Software after any changes constitutes your acceptance of the revised terms.

16. Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and that upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

17. Entire Agreement and Severability

This Agreement is the entire agreement between you and HappyGophers regarding the Software. If any provision of this Agreement is held unenforceable, the remaining provisions remain in full force and effect.
